Shuttle services (“Service”) are provided by CharterUP (“Provider”), an independent service provider. Storm King Art Center (“Storm King”) is not responsible for the provision of the Service. 

As a condition of using this Service, all passengers must agree to the Terms herein. Passengers agree to these Terms on behalf of themselves and any others for whom they are purchasing Services.  

Risk of Injury 

Use of this Service includes the risk of physical injury. All passengers agree to assume the full risk of any injuries, damages or loss, regardless of severity, that may be sustained as a result of participating in any activities associated with receiving the Services, regardless of cause. 

Waiver of Claims 

All passengers, their legal representatives, heirs, and assigns, irrevocably release, waive, discharge, and indemnify Storm King from and against all claims, losses, damages, injuries, demands, suits, actions or costs, including attorneys’ fees, which may be brought by a passenger on their behalf against Storm King related to the Service.   

The sole and total recourse to Storm King for any Claims is the cost of the ticket purchase. 

Other Terms 

Purchases are non-refundable. Purchase of a ticket does not guarantee entrance to Storm King. The service schedule is for guidance only, Services may arrive or depart before or after scheduled times. Purchase of a ticket does not guarantee Service. In its sole discretion, the purchase price of any ticket may be cancelled and refunded and neither Storm King nor the Provider have any further obligation to provide Service. No alternate Services are available or will be provided. The Services may be cancelled at any time for any reason by Providers. This agreement is governed by the laws of the State of New York.
